STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the New, York Central Railroad, Buffalo and
East, that
Mr. Robert O. Kedney, who was regularly assigned to first trick
at "HS" Hastings~on-Hudson, New York, and who was required by
the Carrier to vacate his regular position and travel to Scarborough,
New York, and work as Agent at that station on February 7, 9, 10,
11, and 12, 1948, shall be paid travel and waiting time, plus the
higher rate of pay on each of these dates in accordance with the
provisions of Rule 13 of the Telegraphers' Agreement.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held and under date of July 20, 1948,
the complainant party addressed a formal communication to the Secretary
of the Third Division withdrawing this case, which request is hereby granted.
AWARD
Case dismissed.
