STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on The Indianapolis Union Railway Company, that H. Stegemoller, regularly assigned third trick train director at IU'j tower, Indianapolis, Indiana, assigned hours 12:00 midnight to 8:00 A. M. with rest day on Saturdays, who was required by the Carrier to perform service on his rest day of Saturday, January 11, 1947, 4:00 P. M. to 12:00 midnight on the second trick train director position in the same tower for the convenience and benefit of the Carrier, and not allowed by the Carrier to resume work on his regular position on the following day of Sunday, January 12, 1947, because of the operation of the Federal Hours of Service Act, and not paid for the time lost to him on this day of Sunday, January 12, 1947, shall be reimbursed for the eight hours' work at the pro rata rate of which he was thus deprived on Sunday, January 12, 1947.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That hearing thereon has been held but not concluded. Under date of July 27, 1948, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
