STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(a) Carrier violated the Clerks' Agreement when on July 16, 1946, it failed and refused to pay the established rate of pay of 96'/2 cents (now $1.11) per hour for ten new positions established to Operate motor driven tractors ("Chore Boys") on the Kansas City Freight platform; and,


(b) Theodore Reed, J. L. Navarro, Robert Jones, Henry Robinson, Severs Ojida, Lloyd Brooks, Frank Hernandez, O. L. Lewis, Ben Santillen, William Tipton and/or all oher employes operaing the motor driven tractors ("Chore Boys") shall be paid the difference between 92% cents (now $1.08) and 95% cents (now $1.11) per hour for all service performed in the operation of this equipment, retroactive to July 16, 1946.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of September 2, 1948, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.




    Case dismissed.
