STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that the Carrier violated rules of agreement effective July 1, 1934:
1. When on April 15, 1944 they denied Miss Phyllis Reboul's (now Mrs. Phyllis Horsley), with seniority date of October 26, 1942, following her displacement when position of Stenographer-Clerk was abolished, application to exercise her seniority to position of Roadmaster's Clerk at Manhattan, Kansas, then held by junior employe, E. A. Phillips with seniority date of October 10, 1943.
2. That Miss Reboul (now Mrs. Horsley) be allowed the difference in her earnings as Stenographer-Clerk in the Division Engineer's Office at Kansas City (rate of $185.76 per month) and what she would have earned had she been permitted to place herself on the position of Roadmaster's Clerk at Manhattan, Kansas (rate of $198.76 per month) from April 16, 1944 to date when the position at Manhattan, Kansas, was assigned to a senior employe, viz., December 17, 1945.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held and under date of September 1, 1948, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.
