PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the Terminal Board of Adjustment, Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Empoyes that Carrier violated the Clerks' Agreement:


(1) When effective December 9, 1947 it converted to daily rates the monthly rates previously applied to positions of Chief Janitor and Night Chief Janitor and arbitrarily established daily rates for said positions, arrived at other than as provided for in Rule 45; and


(2) That Mr. Ben H. Bockhorst and Mr. James M. Holleran be compensated for the difference between the daily rates shown on Bulletins dated December 3, 1947 ($9.92 and $9.25, respectively) and the proper daily rates, arrived at by converting the monthly rates to daily rates, as provided in Rule 45, from December 9, 1947, the effective date of the bulletins dated December 3, 1947, until the violation is corrected, and that anyone other than the present incumbents, who may be assigned to fill these positions, be compensated on the same basis.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of October 1, 1948, the complainant party addressed a formal communication to the Acting Secretary of the Third Division withdrawing this case, which request is hereby granted.
