PARTIES TO DISPUTE:





STATEMENT OF CLAIM: This claim is filed on behalf of Earl Williams, former dining car cook on the Southern Railway System, who was dismissed from the service as the result of an investigation of charges that he had violated Rule No. 6 of the Manual of Instructions in Dining and Tavern Car Service and disorderly conduct in the concourse of the Atlanta Terminal Station, which charges were not proved.


Claim is for restoration to service of Mr. Williams with seniority and other rights unimpaired and pay for all time lost as a result of the above action by the Carrier.


OPINION OF BOARD: The evidence of record discloses no grounds for disturbing the action of the Carrier.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employe involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has Jurisdiction over the dispute involved herein; and


That the evidence of record discloses no grounds for disturbing the action of the Carrier.
