PARTIES TO DISPUTE:



SOUTHERN PACIFIC LINES IN TEXAS AND LOUISIANA,

TEXAS AND NEW ORLEANS RAILROAD COMPANY


STATEMENT OF CLAIM: Claim of the Joint Council Dining Car Employes, Local 582, on the property of the Southern Pacific Lines in Texas and Louisiana, Texas and New Orleans Railroad Company, for and in behalf of Mr. Edward Mason, Waiter, to be restored to service with vacation and service rights unimpaired and be compensated for all time lost as a result of unjust and unwarranted discharge in violation of the current agreement and in abuse of the Carrier's discretion.


OPINION OF BOARD: The evidence of record discloses no grounds for disturbing the action of the Carrier.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respeotively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That the evidence of record discloses no grounds for disturbing the action of the Carrier.
