STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad that,
(1) The Carrier violated the terms of the Agreement between the
Carrier and the Organization when it failed to use Telegrapher
R. M. Werner an Extra telegrapher for the tour of duty 10:00
A. M. to 6:00 P. M. February 22, 1947, in the general telegraph
office at St. Louis, Missouri.
(2) Telegrapher R. M. Werner shall be compensated by the Carrier
for eight (8) hours at the time and one-half rate account of
failure of the Carrier to use her on February 22, 1947, 10:00
A. M. to 6:00 P. M.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held and under date of January 7,
1949, the complainant party addressed a formal communication to the Acting
Secretary of the Third Division withdrawing this case, which request is
hereby granted.
AWARD
Case dismissed.
