PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that
(1) J. W Walsh, Iowa City, Iowa, shall be reinstated to his position
of Clerk at Iowa City, Iowa, with full seniority and vacation
rights;
(2) J. W. Walsh, Clerk, Iowa City, Iowa, shall be compensated for
all wage loss suffered from October 28, 1946, until reinstated,
account of unjustly dismissed following investigation October
24, 1946.
OPINION OF BOARD: Based upon all of the facts and circumstances
of this particular case, the Board is not disposed to disturb the disciplinary
action of the Carrier.
FINDINGS: The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon, and upon the whole
record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act,
as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That the discipline imposed by the Carrier will not be disturbed.
AWARD
Claim denied.
