PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that,


(1) The Carrier violated the Clerks' Agreement of September 1, 1944 when, effective October 28, 1946, it established a position of Yard Clerk, Chattanooga, Tennessee, at salary of $213.70 per month (204 hours), instead of at rate of $236.70 per month (204 hours), the rightful salary, and that, therefore,


(2) Yard Clerk Mr. E P. Turner, the occupant of said position then and at the present time, shall now be paid the difference between salary of $213.70 per month (204 hours) and $236.70 per month (204 hours), this difference being $23.00 per month, retroactive to October 28, 1946, and that


(3) Any and all other occupants of this position, if any, shall be paid in like manner for any and all time worked on this position likewise from October 28, 1946 and thereafter.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of February 2, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
