BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes-


1. That Carrier violated rules of working conditions agreement, effective September 1, 1944, when, on or about November 1, 1945 they designated the then existing position of Chief Clerk to the Terminal Trainmaster, Atlanta, Georgia, rate $248.96 per month, to jointly serve as Chief Clerk to the Terminal Trainmaster as well as to the Superintendent of Terminals, Atlanta, a newly created official position, with no adjustment in the rate of pay of said Chief Clerk's position, that was established by agreement for position of Chief Clerk to Terminal Trainmaster.


2. That J. E. Green, occupant of position of Chief Clerk to Superintendent of Terminals, Industry iYards, Atlanta, Georgia, and Chief Clerk to Terminal Trainmaster be paid the difference between $248.96 per month and $327.10 per month retroactive to November 1, 1945. (Note: Rates herein named are susceptible to such further adjustments as have been made by application of general wage increase Agreements to employes since November 1, 1945.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of February 2, 1949, the complainant party addressed a formal communication to the Acting :Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
