PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that the Carrier violates the rule of the Clerks' Agreement at Binghamton, New York when it requires a Roster "B" employe to perform Roster "A" work and,


That the Carrier shall compensate M. Snyder, Comptometer Operator and Typist, a Roster "A" position, at time and one-half rate for three hours daily that H. Stafford, a Roster "B" employe, performs clerical work, properly attaching to the position of Comptometer Operator and Typist, a Roster A" position and,


That H. Stafford, a Roster "B" employe, shall be paid the difference between his rate of $1.124 per hour and the Comptometer Operator & Typist rate of $9.09 per day for all time utilized in performing Roster "A" work and,


That all employes involved who have been adversely affected will be compensated until such time as the violation complained of is corrected, retroactive to October 14, 1947.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held, and under date of March 3, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
