PARTIES TO DISPUTE:
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
THE DELAWARE & HUDSON RAILROAD CORPORATION

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood


(1) That the Carrier violated the provisions of the current working agreement between the Delaware and Hudson Railroad Corporation and the Brotherhood of Maintenance of Way Employes when it did not allow Howard G. Beldon and other monthly-rated employes a wage increase on the basis of 243 hours per month in applying the wage increases as contained in agreements dated April 4, 1946 and May 25, 1946;


(2) That Howard G. Belden and all other monthly-rated employes Who were allowed a wage increase on any basis other than 243 hours per mouth be allowed the difference in pay between what they have received and what they would have received had they been allowed the 160 per hour and the 2%2 per hour increases on the above basis.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held but not concluded. Under date of April 7, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
