STATEMENT OF CLAIM: On January 4, 1948, cars 1635-6054-1649 line Special, which constituted Mains 5597 and 5598 enroute from San Antonio to Kansas City were permitted to operate between Newton, Kansas and Kansas City without the services of a Conductor.
This is a violation of Rules 38 and 64 of the Agreement between The Pullman Company and its Conductors.
As all work arising at Newton is under the jurisdiction of the Kansas City District, I now ask that the Kansas City Conductor who would have been entitled to this assignment be compensated for a deadhead trip Kansas City to Newton and a trip in extra service from Newton to Kansas City. A total of 15 hours.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of May 20, 1949 the complainant party addressed a formal communication to the Acting Secretary of the Third Division withdrawing this case, which request is hereby granted.
