STATEMENT OF CLAIM: The Order of Railway Conductors, Pullman System, contends Rules 38 and 64 of the Conductors Agreement was violated when on February 18, 1948, Pullman cars 381, Line 2358 [2385] and 161, Line 2362 in service were permitted to operate on Pennsylvania train No. 580 Harrisburg to Philadelphia without a Pullman conductor in charge.
We now ask that Conductor E. J. Sunderland be credited and paid for a deadhead trip Philadelphia to Harrisburg and a service trip Harrisburg to Philadelphia, as provided in Memorandum of Understanding, subject: "Compensation Wage Loss" dated August 8, 1945.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and
That no hearing thereon has been held and under date of May 20, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division withdrawing this case, which request is hereby granted.
