PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers Express and Station Employes, that Carrier violated rules of our Agreement effective June 23, 1922 (revised September 1, 1927) governing working conditions of employes of the Carrier when:


A. It compensated M. C. Harris, extra clerk, for services performed while working in this capacity filling the position of the regular incumbent on position No, 127, Clerk, Madison, Illinois, (position designated by Management as one necessary to the continuous operation of the Carrier in the application of Rule 42) at the pro rata rate of pay instead of the rate of time and one-half.


B. That Mr. Harris be paid the difference between pro rata and time and one-half for services performed (8 hours) on each Sunday, January 25, 1948 to February 29, 1948, inclusive (6 days).




That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of January 5,1950, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
