BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: The Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the Carrier violated the Clerks' Agreement.
1. When on April 1 1948 they failed to call George J. Millette, Warehouse Foreman at the Fargo, North Dakota Freight House, to work overtime on his position, and had the work performed by another employe not entitled to the overtime work in preference to Mr. Millette.
2. When they called Peter Lien Assistant Foreman, to work overtime, performing warehouse foreman's work and not properly compensating him.
3. That the Carrier now be required to compensate George J. Millette for five hours at the overtime rate of pay from April 1, 1948, and Peter Lien for five hours at the difference in the overtime rate between the Assistant Foreman's rate and the rate of the Warehouse Foreman for April 1, 1948 and each and every day thereafter at the same rate for the amount of overtime that George J. Millette was deprived of and the difference in the rates due Peter Lien.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of December 15, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
