PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Atlantic Coast Line Railroad Company that the senior idle telegrapher shall be paid a day's pay for 8 hours at the pro rata rate on which train orders, commencing on November 2, 1946, and on all days subsequent thereto, were or may be delivered to train and engine crews at Sprague, Alabama, by a crew other than the one to whom the orders were addressed; and


That the Carrier shall be required to establish in fact a telegraph office at Sprague, Alabama, to provide the necessary service incident to the issuance and the handling of train orders and other communication of record service at that location.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of December 28, 1949, the complainant party addressed a formal communication to the Acting Secretary of the Third Division withdrawing this case, which request is hereby granted.




    Case dismissed.
