THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the provisions of the Rules Agreement, effective May 1, 1942, particularly the Scope, Rule 4-A-6, and
Paragraph 1-B of Supplemental Agreement "A," Canton Freight
Station, Baltimore, Maryland, Maryland Division, January 4 to March
3~. inclusive, 1947, by using so-called emergency or contract employes in lieu of available employes holding regular or regular extra
list positions.
(b) P. G. Wright, K. W. Johnson and others be paid five hours'
pay at time and one-half for each date available during this period.

FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of January 19,
1950, the complainant party addressed a formal communication to the Acting
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
