PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the Carrier violated agreement dated April 1, 1945:


1. When on April 2, 1948 it abolished position of Cashier-Clerk, Cheyenne Baggageroom and assigned major portion of the work of abolished position to Baggage Agent (employe classified as 1(d) ),


2. Merle C. Wilhelm be paid at rate of $267.12 ($278.97 present) per month from April 2, 1948 until violation is corrected.


His position, Cashier-Clerk, rate $267.12 ($278.97 present), abolished and three-fourths of work turned over to Baggage Agent, 1 (d) position. He exercised seniority on Asst. Cashier position at Cheyenne Freighthouse, rate $262.12 ($273.97 present).


3. Geraldine Geahm be paid at rate of $252.12 ($263.97 present) per month from April 18, 1948 until violation is corrected.


Due to senior employes exercising seniority as direct result of abolishing Cashier-Clerk job in Baggageroom, Geraldine Beahm was displaced. As no junior employe working whom she could displace, she was furloughed,


4. Donald Miner be paid at rate of $262.12 ($273.97 present) per month until violation is corrected.


He was displaced from position of General Clerk at $262.12 ($273.97 present) as a result of abolishing Cashier-Clerk job in Baggageroom and exercised seniority on position as clerk, rate $252.12 ($263.97 present),


5. Elvin A. Bailey be allowed an additional $4.80 a month from April 2, 1948 until violation is corrected.


Due to abolishing Cashier-Clerk job in Baggageroom, the relief schedule was re-arranged, so that Elvin A. Bailey earned $4.80 less a month under the relief schedule resulting from abolishing the Cashier-Clerk job,


6. And all other employes that may have suffered wage loss growing out of the Management's abolishing position of Cashier-Clerk as set forth in Item 1 of this statement.

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and

That no hearing thereon has been held, and under date of July 24 1950, the complainant party addressed a forml communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
