PARTIES TO DISPUTE:





STATEMENT OF CLAIM: (1) That the Pennsylvania Railroad Company violated its Agreement, effective September 1, 1938, with its Train Dispatchers, represented by the American Train Dispatchers Association, when, effective with the issuance of Time Table No. 11 at 12:01 A.M., Sunday, September 26, 1948, the Madison Branch was made a Secondary Track and the operation of trains on this Branch was placed under the control of Block Operators at Columbus, Indiana.


(2) That the Pennsylvania Railroad Company shall be required to pay the senior extra Train Dispatcher who was not performing train dispatcher service the difference between the amount he earned and was paid for the service he did perform, and the amount he would have earned and was entitled to receive had he been used in train dispatcher service, for each day except Sundays commencing with September 26, 1948 and until December 11, 1948 inclusive, when the supervision of the said Madison Branch was returned to the Train Dispatchers under the provisions of General Order No. 1102.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held, and under date of July 27 1950 the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
