BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes, that:
The Carrier violated the Clerk's Agreement of September 1, 1944, when, effective with the close of business Saturday, June 25, 1949, it abolished the position of Assistant Warehouse Foreman, salary $322.60 per month (now $320.17 per month), assigned hours 8:30 A.. to 5:30 P.M., daily, except Sundays and permitted the transfer of many of the duties assigned for many years thereto to Transfer Clerk and other positions carrying lower rated salaries and that therefore-
1. The position of Assistant Warehouse Foreman, salary $322.60 per month (now $320.17 per month) shall be restored and the incumbent, thereof, Mr. J. B. Hardy, shall be compensated for the difference between the salary of $322.60 per month (now $320.17 per month) and what he has earned since June 25, 1949, that:
2. Any and all other Macon Freight Agency employes in this seniority district (Macon Division No. 3) shall be compensated in like manner for the differences between all salaries received and those that properly should have been received had this position not been illegally abolished.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of September 18, 1950, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
