PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway & Steamship Clerks, Freight Handlers, Express & Station Employes, that:


(a) Carrier violated rules of the current Agreement effective June 23, 1922, revised September 1, 1927, governing the hours of service and working conditions of employes represented by the Brotherhood when, commencing April 30, 1948 and continuing to May 6, 1948, during the absence of Mrs. Schroeder regularly assigned occupant of clerical position No. 107, rate $9.27s/~ per day, in office of Car Accountant, 63rd Street, Chicago, Management assigned to the performance of duties normally attached to said position (No. 107) the regularly assigned Bureau Chief (Miss Jane Smith) which position is excepted from rules of the aforesaid Agreement.


(b) Miss Dorothy Garty, senior employe within the group of twelve (12) clerical employes in the Car Accountant's Office engaged in miscellaneous record work such as checking in and sorting, inspecting and filing Conductors Wheel Reports and checking the Mechanical Repair Cards, be paid for the number of hours of service performed by Miss Smith on clerical position No. 107, viz.:





at punitive overtime rate of $13.91 per day or rate attached by Agreement to position No. 107 said 28 hours representing the number of hours overtime absorbed by Management's action in denying this to the senior clerical employe and assigning it to be performed by an employe not occupying a position embraced within the Scope Rule of our Agreement effective June 23, 1922, revised September 1, 1927.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and

That no hearing thereon has been held, and under date of October 30, 1950, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted .
