STATEMENT OF CLAIM: Claim of Joint Council Dining Car Employes, Local 495, for and on behalf of Harry W. Cage on the property of Seaboard Air Line Railroad Company that Waiter Cage be compensated for period of September 16-30, 1948, inclusive, Waiter Cage having been held out of service for said period as discipline assessed in violation of agreement.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That no hearing thereon has been held and under date of November 13, 1950, the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby granted.
