PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
CENTRAL RAILROAD COMPANY OF NEW JERSEY
CENTRAL RAILROAD COMPANY OF PENNSYLVANIA
STATEMENT OF CLAIM: Claim of the General Committee of The Order
of Railroad Telegraphers on the Central Railroad Company of New Jersey,
that:
1. The Carrier violated the terms of the Telegraphers' Agreement
when effective September 19, 1949, it declared abolished two assignments of Ticket Agent-Operator at Scranton, Pennsylvania,
3:00 P.M. to 11:00 P.M., and 11:0'0 P.M. to 7:00 .M., without in
fact discontinuing the work previously performed by the two
ticket agent-operators at that point, and transferred the work of
those positions and assigned the performance of the same to
employes not covered by the Telegraphers' Agreement; and
2. The work formerly performed by the two ticket agent-operators
at Scranton, shall be restored to the Telegraphers' Agreement
and performed only by employes coming within the Scope of such
Agreement; and,
3. All employes adversely affected by the Carrier's action in arbitrarily removing from the Telegraphers' Agreement work previously performed by the ticket agent-operators at Scranton, shall
be compensated for all monetary losses sustained, plus any necessary expenses incurred.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of December 5,
1950, the complainant party addressed a formal communication to the Acting
Secretary of the Third Division, requesting withdrawal of this case, which
request is hereby granted.
