STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) The Carrier violated the provisions of the Rules Agreement, effective May 1, 1942, when, on January 25, 26 and 31, and February 1, 1949, it blanked positions of Tractor Operator and assigned the incumbents thereof to extra work accruing to Chauffeurs in violation of Rule 4-C-1 at Altoona Car Shop, Altoona Works, Altoona, Pennsylvania.
(b) J. M. Bauer, Chauffeur, be paid at the rate of time and one-half for eight hours each day, January 25, 26 and 31, and February 1, 1949, in accordance with Rule 4-A-6. (Docket A-68.)
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That hearing thereon has been held but not concluded. Under date of April 6, 1951, the complainant party addressed a former communication to the Acting Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
