STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May 1,
1942, particularly Rules 4-A-2 and 4-A-7, South Philadelphia
Freight Station, Philadelphia Terminal Division, on January 1,
1947, by not allowing certain employes a day's pay for January 1, 1947.
(b) Daniel Dennis, David Mims Arthur Mims, A. D. Mims and
J. Mitchell each be allowed a day's pay at punitive rate on
account of this violation. Docket E-556.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of April 2 1951,
the complainant party addressed a formal communication to the Acting
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
