PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
SOUTHERN PACIFIC COMPANY (PACIFIC LINES)
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the Southern Pacific (Pacific Lines) that:
1. The Carrier violated the terms of the agreement between the
=a ie8 when on August 7 and August 9, 1948, without cone'ce and agreement, it removed from the agent-telegrapher
at Isleton, California, he duties of signing bills of lading and
waybilling carload reight, which duties are regularly performed by him during his regular assigned hours, and improperly transferred such duties to conductors-employes not
subject to said agreement.
2. As a result of this violation, the carrier shall be required to
compensate D. V. Chandler, the regularly assigned agenttelegrapher at Isleton, California, under the overtime rule 14,
August 7, 1948; and under the call rule 16, August 9, 1948,
for the work thus denied him.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board jointly by the parties; and
That no hearing thereon has been held, and under date of April 19,
1951, the parties jointly addressed a formal communication to the Acting
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
