STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) Carrier violated and continues to violate the Rules of the Clerks' Agreement when it refused and continues to refuse to compensate unassigned Telephone Operator Elizabeth Embree, Los Angeles, California, at the rate of time and one-half for service performed on Sunday, August 6, 1950, which service was in excess of forty (40) straight time hours and more than five (5) days in her work week.
(b) That unassigned Telephone Operator Elizabeth Embree shall now be compensated for eight (8) hours at the rate of time and one-half in lieu of eight (8) hours straight time compensation allowed for service performed on Sunday, August 0, 1950.
FINDINGS: The Third Division of the Adjustment Board upon the whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the hallway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board by Ex Parte Submission; and
That under date of September 25, 1951, the parties jointly advised the Acting Secretary of the Third Division of their desire to withdraw this case from further consideration. by the Division, which request is hereby granted.
