STATEMENT OF CLAIM- (1) The Carrier violated the Agreement when it did not compensate Fred Peralto, M. S. Alexander, Leo B. Jeffries and Fred Hulme, employes of B & B Gang No. 4, Oklahoma Division, two (2) hours each, on each of the following days: January 10, 15, 18, 22, 24, 26, 29 and 31, 1949, for reporting for duty and not being used account of "Inclement Weather."


(2) That the above mentioned employes be compensated as stated in Part one (1), of statement of claim.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That no hearing thereon has been held and under date of October 4, 1961, the duly authorized representative of the Employes addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case for reasons explained, which request is hereby granted.
