STATEMENT OF CLAIM: (1) That the Carrier violated the intent and purpose of Article VI, Section 17, of the agreement, by refusing to allow regularly assigned employes of B&B Gang No. 3, Panhandle Division, to report for duty at the starting time of their regular assignment November 19, 1948.


(2) That E. A. Wheeler, S. L. Buntin, H. A. Johnson, E L. Carlisle and W. M. Smith, employes of Panhandle Division, B&B Gang No. 3, be allowed pay for two (2) hours each at pro rata rate on November 19, 1948.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and


That no hearing thereon has been held and under date of October 4, 1951, the duly authorized representative of the Employes addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case for reasons explained, which request is hereby granted.
