STATEMENT OF CLAIM: (1) That the Carrier violated the agreement by laying off entire Section Gangs on the Missouri Division for a short period between January 13 and 17, 1949.

(2) That certain named employes be paid for all time lost.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and

That no hearing thereon has been held and under date of October 4, 1951, the duly authorized representative of the Employes addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case for reasons explained, which request is hereby granted.
