STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:
(1) That the Carrier violated the effective agreement when they
failed to reimburse W. B. Prima for necessary expenses incurred when
he was required to leave his regular headquarters and perform relief
Section Foreman's duties;
(2) That the above referred to employe be reimbursed for all
necessary expenses incurred while assigned as Relief Section Foreman.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of October 15, 1951,
the complaint party addressed a formal communication to the Acting Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
