PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the Terminal Committee of the Brotherhood that:


(1) The carrier violated the intent and provisions of the Clerks' Agreement on November 30, 1949. and subsequent dates, when it went outside the scope and application of the Agreement and filled temporary vacancies in its Pullman Reservation Bureau with individuals who had no seniority rights in preference to scheduled employes who were entitled to the work, and


(2) That such individuals' names shall be removed from the seniority roster, and


(3) That Employes David I. Colp, Chas. A. Pickard, Stanley Thibault, Celia Carson, Margaret Preziose, John W. Welch, Morgan J. Nee, Daniel Pickard, Gertrude McDermott, Earl R. Jenkinson, John A. Hardiman shall be compensated for all monetary loss on November 30, 1949, and subsequent thereto until the condition has been corrected and their names are shown on the seniority roster as of the date they should have been allowed to fill these vacancies in seniority order; also, that Claimants be allowed to exercise such seniority to any bulletined positions or temporary vacancies which have been assigned to outsiders or junior employes since that time.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of January 2, 1952, the complainant party addressed a formal communication to the Acting Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.




    Case dismissed.
