PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on The Pennsylvania Railroad that
(1) With the issuance of General Order No. 1110 effective
September 1, 1949 establishing Block Limit Stations at hours not
heretofore in effect at Huntertown, Indiana; LaGrance, Indiana;
Howe, Indiana; Shelbyville, Michigan; Wayland, Michigan; Howard
City, Michigan and Mancelona, Michigan, on Saturdays in lieu of
the attended block stations at these locations on that day is in
violation of the agreement between the parties to this dispute, and
(2) this violation of the agreement shall be corrected and
any employes suffering a loss of earnings subsequent to September
1, 1949, and until such violation is corrected shall be compensated
for such loss of earnings, if no extra operators were available then
the Carrier shall pay the regular incumbent of the position eight
(8) hours at time and one-half for each Saturday.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That hearing thereon has been held but not concluded. Under date of
February 21, 1952, the complainant party addressed a formal communication
to the Acting Secretary of the Third Division requesting withdrawal of
this case from further consideration by the Division, which request is hereby
granted.
AWARD
Case dismissed.
