STATEMENT OF CLAIM:
Claim of the System Convnittee of the
Brotherhood that:
(a) The Carrier violated the Clerks' Agreement at Settegast
Freight Station, Houston, Texas, on February 8, 11, 12, 13, 14 and
15, 1952, when it required or permitted Delivery Clerk M. C. Wynn
to suspend work on his regularly assigned position in order to work
temporary position of Assistant Warehouse Foreman. Also
(b) Claim that Mr. Wynn be paid additionally at the Delivery
Clerks' rate of pay for the six days he was withheld from that
position.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of December 16,
1952, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
