PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES





STATEMENT OF CLAIM: Claim of the System committee of the Brotherhood of Railway Clerks, Freight Handlers, Express and Station Employes, that the Carrier violated the provisions of the Agreement between the parties, when:


1. It required Clerk E. C. Willis to work Saturdays performing the work and taking the responsibilities of the Head Clerk on the Car Service Desk, and,


2. Commencing with the payroll week of December 30th, 1951, E. C. Willis be paid the Chief Car Service Clerk's rate for every Saturday he worked, and,


3. The Carrier violates the Agreement every Monday, when it requires Check Clerk Curtin and Mrs. Goodwin to suspend their regular work to perform Willis' work that day, and


4. The senior available extra employe should be compensated for eight (8) hours at the straight time rate for each Monday such violation was permitted by the Carrier; if no extra or furloughed employe available, then the regular employe, E. C. Willis, be paid eight (8) hours at punitive time for every Monday commencing with the payroll period of December 310th, 1951, and subsequent thereto until the condition is corrected.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of February 27, 1953, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
