ORDER OF RAILWAY CONDUCTORS, PULLMAN SYSTEM
THE PULLMAN COMPANY
STATEMENT OF CLAIM: The Order of Railway Conductors, Pullman
System, claims for and in behalf of Conductor J. W, Burk, Chicago Central
District, that:
1. Rules 38(b), including (Question and Answer 1), 13, and
23 of the Agreement between the Pullman Company and its Conductors were violated on February 20-21, 1951, when the Company
improperly annulled an assignment held by Conductor Burk, subsequently failed to release him at Kansas City, and later improperly
paid him on the basis of continuous service Junction City to Chicago.
2. Conductor Burk be credited and paid the additional amount
of five hours due him in keeping with the applicable rules of the
Agreement.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of March 31,
1953 the complainant party addressed a formal communication to the Secretary of the Third Division withdrawing this case, which request is hereby
granted.
AWARD
Case dismissed.
