PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY

STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the Missouri Pacific Railroad that:
1. the Carrier violated the terms of the effective agreement between the parties when it failed and refused to compensate Telegrapher J. L. Simpson for services performed at Fort Smith, Arkansas,
in accordance with said agreement on the following dates: September
5; October 31; November 7, 14, 21, 28; December 5, 12, 19, 26, 1949;
January 2, 9, 16, 23; April 17, 24; May 8; June 26, and August 21,
1950; and
. 2. the Carrier shall, by appropriate award and order, be required
to compensate said J. L. Simpson in an amount equal to te difference
between 2 hours at rate of time and one-half, which was paid, and
8 hours at rate of time and one-half, to which he was entitled, for
each of the above dates.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That hearing thereon has been held but not concluded, and under date
of June 1, 1953 the parties addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
