STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that the Carrier violated the Clerks' Agreement,
1. When on January 17, 1951, the Carrier set up a so-called combination clerk and relief position at Billings Freighthouse, Billings, Montana, in violation of Rule 43.
2. That the Carrier now be required to compensate E. J. Carbone at the time and one-half rate for Saturday and Sunday, also. at the straight time rate for Tuesday and Wednesday, his days off, and for each and every day that this violation continued.
3. That Clerk A. J. Holtzbauer be compensated at the time and one-half rate for Saturday and Sunday and at the straight time rate for Monday, and for each and every day that this violation continued.
4. That Clerk C. S. Konecny be compensated for eight hours at the time and one-half rate for each Saturday and Sunday he was not called to perform work on his position on these two days, account employe assigned to a relief position, and for each and every day that the violation continued.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of June 2, 1953, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
