PARTIES TO DISPUTE:
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
CHICAGO AND EASTERN ILLINOIS RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood, that:
(1) The Carrier violated the agreement when it required
Bridge and Building Foreman H. Phillips and G. C. Drake and the
employes under their supervision to suspend work during their
regular assigned hours from April 12 to April 16, 1948, inclusive,
and Foreman Phillips and his crew to again suspend work during
their regularly assigned work period from May 10 to May 14, 1948
inclusive, and, in lieu thereof, required them to perform work during certain hours outside of their regular assignment at their respective straight time rates of pay;
(2) Bridge and Building Foreman Phillips and Drake and
the employes under their supervision be allowed pay at their respective straight time rates for each hour in which they were required
to suspend work during their regularly assigned work periods;
(3) Bridge and Building Foreman Phillips and Drake and the
employes under their supervision be allowed in addition to compensation received and in addition to that claimed in part (2) of
this claim, the difference between what they were paid and what
they should have received at their respective time and one-half
rates for the period referred to in part (1) of this claim;
(4) The Cook assigned to the gang supervised by Foreman
Drake, be allowed, in addition to that claimed in parts (2) and (3)
of this claim, two additional hours at his time and one-half rate
of pay for each day of the period referred to in part (1) of this
claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein; and
That hearing thereon has been held and concluded. Under date of
June 17, 1953, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
