THE ORDER OF RAILROAD TELEGRAPHERS

GEORGIA RAILROAD

STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Georgia Railroad that:

(1) The Carrier violated the provisions of the agreement between the parties when it assigned the working days of the agenttelegrapher at Woodville, Georgia and the agent-telegrapher at Crawford, Georgia, Tuesday through Saturday with rest days of Sunday and Monday and

(2) The Carrier shall now compensate the occupants of the two positions named in paragraph 1 at the straight time rate for eight (8) hours for each Monday the occupants were suspended from work, and for the difference between straight time and time and one-half no each Saturday, both for the period of time such assignment existed.

FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;

That the dispute was certified to the Third Division of the Adjustment Board ex parte by complainant party; and

That hearing thereon has been held and concluded. Under date of July 7, 1953, the Organization addressed a formal communication to the Executive Secretary of the Third Division, requesting withdrawal of this case from further consideration by the Division. Under date of July 14, 1953, the Carrier addressed a formal communication to the Executive Secretary of the Third Division concurring in the Organization's request for withdrawal of this case from the Board. The request of the parties is hereby granted.
