PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May 1
1942, particularly the Scope and Rule 9-A-1, when it transferred
certain clerical work to employes of the Terminal Railroad Association at St. Louis, Missouri, which, prior to February 15, 1948, had
been performed by Group 1 employes (Crew Dispatchers) of the
Pennsylvania Railroad Company located at Rose Lake Yard Office,
East St. Louis, Illinois, Southwestern Division.
(b) The senior available Group One employe be allowed a three
hour call at the appropriate rate of pay beginning February 15,
1948 and for each date thereafter until the violation is corrected.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of June 26,
1953, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
