STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the Clerks' Agreement in the office of
Auditor Disbursements, Jersey City, N. J., from January 22nd to
March 19th, 1952 incl., when it withheld Vacation Clerk C. Howarth from her regular assigned position and required her to perform the work of position °B-5", and
(b) Clerk C. Howarth be compensated for eight (8) hours each
day at the rate of her regular assignment, in addition to compensation previously allowed for service performed on position "B-5".

FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of July 17,
1953 the parties jointly advised the Secretary of the Third Division of
their desire to withdraw this case, which request is hereby granted.
AWARD
Case dismissed.
