PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MAINE CENTRAL RAILROAD COMPANY
STATEMENT OF CLAIM:
"Claim of the General Committee of The
Order of Railroad Telegraphers on the Maine Central Railroad that;
(a) The Carrier violated the provisions of the Telegraphers'
Agreement when and because it refused to assign E. P. Dumont to the
agent-telegrapher position at Livermore Falls, which position was
advertised for applications by bulletin dated
March 17,
1952; and
(b) E. P. Dumont shall now be assigned to the agent-telegrapher position at Livermore Falls and be paid under the provisions of Article 15, of the Telegraphers' Agreement, from twenty (20)
days subsequent to March 17, 1952, to the date he actually and physically occupies the said agent-telegrapher position."
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board jointly by the parties; and
That hearing was waived and under date of August 17, 1953, the
parties jointly addressed a formal communication to the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
