PARTIES TO DISPUTE;





STATEMENT OF CLAIM: The question involved is whether or not the petitioner should be reinstated to his former position as a steward, with pay for all time lost, without any deduction for outside compensation, and with seniority rights unimpaired.


OPINION OF BOARD: The evidence of record reveals that this claim was not submitted to nor handled with the Carrier in accordance with the terms of the controlling agreement.


FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:




That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and






    Claim denied.
