PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MAINE CENTRAL RAILROAD
STATEMENT OF CLAIM:
Claim of the General Committee of The Order
of Railroad Telegraphers on the Maine Central Railroad that
(a) The Carrier has violated and continues to violate the terms
of the Union Shop Agreement, signed August 29. 1952, and effective
September 15, 1952, when and because it has permitted and continues to permit F. L. Carsley to occupy the General Agent (Minor)
position at Rockland, Maine, contrary to the provisions of the said
Union Shop Agreement; and
(b) In consequence thereof F. L. Carsley who occupied the position on September 15, 1952 and has occupied it since shall as a condition of continued employment become a member of The Order of
Railroad Telegrapbers in accordance with the provisions of Section
1, of the Union Shop Agreement.
FINDINGS: The Third
Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That hearing was waived and under date of November 5, 1953, the parties
separately addressed formal communications to the Secretary of the Third
Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Case dismissed.
