DENVER AND RIO GRANDE WESTERN
RAILROAD COMPANY
STATEMENT OF CLALM: Claim of the System Committee of the
Brotherhood, that:
(1) The carrier violated the effective Agreement when it
assigned a general contractor to perform the work of installing certain culverts in the East Yard. Grand Junction, Colorado, during the
period June 9 to June 13, 1952, both dates inclusive;
(2) Bridge and Building Foreman Claude R. White, B&B Carpenters Kenneth C. Clark, Robert L. Evans, Albert L. Givin, Ronald
R. Skinner; and B&B Helpers Ralph M. Buck, Alfred J. Enos, John
P. Santz, and Farley E. Towns be allowed pay at their respective
straight time rates for an equal proportionate share of the total man
hours consumed by the contractor's employes in performing the work
referred to in Part (1) of this claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of November
30, 1953, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
