PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
RAILWAY EXPRESS AGENCY, INC.
STATEMENT OF CLAIM:
Claim of the District Committee of the
Brotherhood that:
(a) The Agreement governing hours of service and working
conditions between Railway Express Agency, Inc. and the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employee, effective September 1, 1949, was violated at
San Francisco, Calif., when the Carrier failed to call and permit furloughed employe Dee Draper to fill a vacancy existing on position
titled "Clerk", group 22, position 7, on October 29 and all subsequent
work days until December 7, 1951 inclusive; and
(b) She shall now be compensated for each day she was denied
the right to work the position of "Clerk", retroactive to and including
October 29, 1951.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of November 27,
1953. the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
