STATEMENT OF CLAIM: Claim of Raymond N. McNab, second telegrapher, in "GN" telegraph office, of the Colorado and Southern Railway, at Denver, Colorado, for additional wages, as compensation for work performed outside the office in which assignment is held; i.e. telegraphers' work performed in another telegraph office, owned and operated by a Railroad; other than the carrier; viz: The Chicago, Burlington & Quincy "PH" telegraph office-in addition to the duties of "GN" office-on instructions of Colorado and Southern Officials. The amount to be determined by a check of the pay rolls, from March 5th, 1947, one day's pay-eight hours-for each day, or portion of a day that such work is performed, and at the hourly rate applicable to the office in which such outside work is required to be done. The amount so determined to be over and above the wages paid for services rendered in the carrier's "GN" office, commencing March 5th, 1947, payment to be continued during the period that the petitioner is required to perform such outside work.
OPINION OF BOARD: Based on the particular facts and circumstances of record in this case, the claim should be dismissed.
FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:
That the carrier and the employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934; and
That there is no existing dispute between the parties to the controlling Agreement over which this Division of the Adjustment Board has jurisdiction.
